Booking Terms & Conditions

1. YOUR SIGNATURE:
The person signing and /or completeing the Booking Form accepts these conditions on behalf of himself / herself and all other named persons on the Booking Form and represents that he or she is authorised to accept these conditions on behalf of such others. 

2. THE CONTRACT:

No contract shall exist between Overland NZ and the Client until the Company (ONZ) has received the deposit and completed Booking Form, and the Company (ONZ) has confirmed the booking to the Client or the client’s Travel Agent. 

3. PAYMENT:

The balance of the tour cost must be paid no later than 4 weeks prior to the departure date for all tours. Otherwise Overland NZ may treat the booking as being cancelled by the client. Bookings made within 4 weeks of departure must be paid in full.

4. AMENDMENTS:
Changes or amendments to your booking will incur a $50 charge per amendment.

5. CANCELLATION BY THE CLIENT:

Should a Client wish to cancel a booking, the cancellation will take effect from the date Overland NZ receives written notification. The applicable cancellation charges are as follows:

  • Cancellations more than six weeks before departure: Loss of Deposit
  • Cancellations between two and six weeks of departure: Loss of Deposit + 25% of balance
  • Cancellations within two weeks of departure: Loss of Deposit + full balance

You can transfer to another trip at any time if a place is available. A transfer fee of $25 applies. After such a transfer any cancellation will result in forfeiture of full payments made. We recommend you take out travel insurance covering medical expenses, personal accident, cancellation and personal property.


6. CANCELLATION BY THE COMPANY:

Overland NZ reserves the right to cancel a tour in the event the minimum number of passengers is not met, or for any other reason determined by the Company (ONZ) prior to departure. Clients must bear this in mind when booking non refundable or restricted flights and insurance as Overland NZ shall not be liable to compensate or refund any losses as a result of a tour cancellation. If Overland NZ does deem it necessary to cancel a tour, we shall offer you the chance to transfer to another departure, or you will recieve full (paid) monies back for the tour and any additional expenses, if incurred, will be borne by you.

7. CONVEYANCE OF THE CLIENT:

The conveyance of the Client, his or her luggage and personal property during the tour by any carrier, other than Overland NZ, is subject to the terms and conditions of that carrier. The conveyance of a Client by Overland NZ is subject to the terms and conditions of Overland NZ. If, due to circumstances beyond the reasonable control of Overland  NZ, the Company (ONZ) may at any time cancel the remainder of the tour or section of it or modify any tour itinerary or route as it sees fit. The Client shall be bound by any cancellation or alterations made under the provisions of this clause and shall not be entitled to recover any sum paid by him or her unless the whole tour is cancelled prior to commencement. The final decision on the itinerary and the conduct of the tour will be taken by the Tour Leader and will be in the interests of the tour group as a whole. The Client will accept the authority and decisions of the Tour Leader as appointed by or on behalf of Overland NZ. 

8. CLIENTS RESPONSIBILITY:

The client must acknowlegde that participation on any of the tours in our brochure or website may involve a certain degree of personal risk. The client acknowledges that his/her decision to travel to their chosen destination is willing to assume the personal risk upon such travel.

9. UNUSED SERVICES:
There will be no refund for unused services if you decide to leave our tour before your booked end date.

10. INSURANCE:

Before the Client commences a tour he or she must obtain travel insurance with a reputable insurer to cover personal injury, medical expenses, repatriation expenses, loss of luggage and the expenses associated with cancellation or curtailment of a tour. The Client is responsible for any loss or damage to baggage or personal possessions or any consequential loss resulting there from. If a Client becomes ill, all hospital expenses, doctors fees and repatriation costs are the responsibility of the Client and the Company (ONZ) shall not be liable for any refund of the tour cost. 

11. PRICES:

Prices quoted in this brochure were correct at the time of printing. However, as external factors may affect the exchange rates, transportation taxes, operational and administrative costs, we reserve the right to increase the price up to the day of departure. If after departure additional expenses are incurred through delay, accident or disruption of advertised schedules beyond the control of the Company (ONZ), such expense must be borne by the Client. 

12. CHANGES TO YOUR ARRANGEMENTS:

All tours and associated arrangements are subject to alteration without notice if necessary because of factors beyond the control of Overland NZ, including, but not limited to exchange rate changes, political disputes, climatic variations, airline departure time changes, although where possible, details of such alterations will be sent to the last known address of the Client as soon as the Company is aware of such alterations. The Company (ONZ) reserves the right to alter itineraries if it is in the interest of the Client to do so. 

13. RISKS:

Whilst the Company (ONZ) will take all reasonable precautions to provide for the Client’s safety and comfort, the Client accepts that these tours carry inherent risks and any Client wishing to participate in such activities must be able to assume this risk. The Client must be in good health to join these tours. Neither the Company nor its servants or its agents shall be liable for personal injury, damage or loss - including consequential loss - to any Client however caused. This includes personal injury caused or contributed to by the negligence, breach of contract or duty to the Company’s servants, agents or any independent contractor whether English or foreign law. 

14. COMPLIANCE WITH LOCAL LAWS:

The Client will comply strictly with all laws, customs and foreign exchange restrictions of any country visited. The Company shall not be responsible or liable for any Client who contravenes any law or regulation of any country visited. 

15. UNSUITABILITY OF CLIENT:

If the Company (ONZ) considers the client unsuitable for a tour it may, in its absolute discretion, cancel such Client's booking or decline to carry the Client further if that Client causes inconvenience or annoyance to other passengers.

16. FOOD & CAMPING COSTS:
Ths is part of the overall tour price and once paid will not be refunded if the client cancels or leaves the tour for any reason.

17. COMPLAINTS:

If the Client has any complaint about the tour booked he or she should first bring this to the attention of the Tour Leader. If at the end of the tour, the client feels that his or her complaint has not been properly dealt with, the Client must notify the Company (ONZ) in writing within 30 days of completion of the tour. No compenstion will be paid to any client that has completed their tour with the company.

18. FOOD ALLERGIES:

The client must notify the Company (ONZ) of any food allergies you have at the time of booking. Further it is the Clients repsonsibility to ensure the food that is prepared is suitable for you. 

19. OPTIONAL EXTRAS:

These do not form part of the tour or contract. The client accepts that any assistance given by the Tour Leader or representive in arranging such activities does not render the Company (ONZ) liable for optional extras. These optional extras are not included in your tour price. Overland NZ is not responsible for the Client when he or she embarks on any optional  activity. Overland NZ does not necessarily endorse any optional activity available on the tour.

20. CREDIT CARD PAYMENTS:

If a credit or charge card is used to pay either deposit or balance payment then a 2.5% surcharge will be levied on the amount (This will be a 4% charge if booked with a US or Canadian card). This amount is subject to change without notice depending on country of payment..

21. WEBSITE / BROCHURE:

Information given in the brochure, leaflets and advertising material is given in good faith by Overland NZ at the time of print, but unless specially stated, shall not form any part of the contract. The Company reserves the right to use photos or video footage and comments taken during your tour for any advertising or brochure production without obtaining further consent.
